The Herbal-O affiliate program is a one-tier affiliate tracking system. Webmasters who enroll in the Herbal-O affiliate system receive 30% of every user's initial product purchase (not including shipping and handling). If that same referred user buys multiple products, you will earn 30% on every single product purchased. That's why our most successful webmasters promote multiple products.

By enrolling in the Herbal-O affiliate program, you agree to promote any of the Herbal-O products using the auto generated Herbal-O affiliate program tracking code. Renewals product sales for referred users are not applicable to the 30% affiliate payout. In addition, webmasters you refer are not automatically subject to your commission plan. You are 100% responsible for the success or failure of your referral campaigns. Herbal-O recommends placing banners, console, text links, etc. promoting any or all of our products in a variety of places where users surf (such as members' areas, exit consoles, mailers). The more places you promote the Herbal-O products, the more success you will have and the greater commissions you will earn.

Herbal-O offers an opportunity for owners/operators of Internet Web sites to direct traffic to its Site(s) and earn 30% of every initial sale. (Herbal-O reserves the right to re-bill consumers. The webmaster commission does not apply to re-bills or re-orders.

E-mail Spamming is strictly prohibited. This includes e-mail spamming, newsgroups, and IRC. If you violate this term of your agreement you will be terminated from the program and will not be paid. Spam complaints will be reported to the FBI.

The terms and conditions of this Agreement are as follows: 1. How Herbal-O Operates:   1.1 The method by which visitors shall be directed to Herbal-O Site is known as an internet "hypertext transfer" link. Herbal-O will let you decide how to send traffic. We recommend using our strategically designed banners or sales tools to promote our products, but you may create your own link descriptions or banners.   1.2 Upon sign-up you will receive an e-mail confirming your participation. This welcome e-mail contains the URL to which you will link from the banner(s) appearing at your site. You must use the URL provided to you in order to receive credit to your account. "Blind links," or any way you can direct sign ups is all right with Herbal-O. Spamming is Not Allowed and is cause for your account to be Terminated without Notice. All sign-ups made by spam will not be paid. Here Is Your Warning: If you Spam, you don't get paid. Herbal-O maintains a Zero tolerance to Spam of any kind to any organization. This includes Affiliates who Spam to AOL or any other Agencies or Organizations that do not allow Spamming. Affiliates who Spam to AOL will not be tolerated and will be Terminated from the Herbal-O program and will not be paid on any such Accounts.   1.3 Upon sign-up you will be asked to enter a User Name and Password. Please remember it, as you will need it in order to access your Account Statistics. You may access your Account Statistics by choosing the appropriate icon on the Herbal-O Home Page. 1.4 Your commission shall be earned on each "sign up," which occurs when a user enters a Herbal-O sites main page with an IP address that has not been identified before and falls within the parameters defined by Herbal-O. 2. Site Owner/Operator Obligations:   2.1 You are required to enter a Federal Tax ID or Social Security Number on the registration form. Herbal-O will register a 1099 for all US domestic entities or a 1042-s for all foreign entities to whom we issue combined yearly payments of $600.00 or more. 3. Rights Granted:   3.1 Herbal-O grants to the person or entity, who is the owner/operator of an Internet site (hereinafter "site Operator") the non-exclusive right to direct (refer) users or visitors to their Web site to Herbal-O's Web Sites.   3.2 Herbal-O grants to site Operator a limited, non-exclusive, nontransferable license, during the term of this Agreement, to use graphics, including banners, and other intellectual properties (hereinafter "marks") owned by Herbal-O for the sole purpose of marketing, advertising and promoting Herbal-O Site. The site Operator may alter or modify the link or banner, or any other marks, in any way, without the prior permission of Herbal-O.   3.3 The rights granted herein shall be for reasonable, appropriate and lawful use, only.   3.4 Herbal-O reserves the right to terminate any webmaster from the program at Herbal-O's sole discretion at any time and without warning. If your account is terminated, you will be notified to remove links. If, however, our links continue to generate sales after notice of termination, Herbal-O will not pay you any commission for those sales.   3.5 Participation in the Herbal-O affiliate program does not, by any means, represent an ongoing partnership with Herbal-O, or any of its subsidiaries. As long as you are a member in good standing, you will be paid consistently and on time. 4. Site Operator Commission:   4.1 Commissions shall be paid on a once a month basis, except that commissions must reach a minimum of fifty dollars ($50.00) before a payment will be issued. All payments will be made by check in US dollars, on the 20th of the following month. 5. Representations and Warranties:   5.1 You, as site Operator, warrant and represent that you own or operate a lawful and otherwise valid Internet Web site. You further represent that you have the requisite power and authority to enter into this Agreement and perform the obligations set forth herein and that you are an adult at least eighteen (18) years of age; that performance under this Agreement does not and will not constitute a breach of any existing contract or obligation undertaken by you; and that there are no outstanding orders, judgments, decrees, rules or regulations which would preclude you from entering into this Agreement. You shall indemnify Herbal-O and its shareholders, officers, directors, employees and assigns against any loss, damage, liability (including reasonable legal fees) which result from the use of any Herbal-O materials not expressly authorized by this Agreement. 6. Disclaimer and Limitation of Liability:   6.1 Herbal-O makes no warranties, either express or implied, with regard to the performance of the link or the content of Herbal-O Site and Herbal-O expressly disclaims any warranties, including that of merchantability or fitness for a particular purpose. Herbal-O shall not be held liable to the site Operator or any other person or entity, including users of Herbal-O services, for any losses, injuries or damages of any kind, arising from or in connection with any mistakes, omissions, delays, errors, interruptions in the transmission or receipt of Herbal-O services or content.   6.2 Nothing in this Agreement shall be construed as to create a partnership, agency or employment relationship between you and Herbal-O.   6.3 The Herbal-O affiliate program is NOT a multi-level marketing (MLM) program. It is an affiliate tracking system. You will not receive credit or monetary remunerations for webmasters you refer to the Herbal-O affiliate program. 7. Term and Termination of Agreement:   7.1 The term of this Agreement shall be indefinite. Herbal-O reserves the right to terminate this Agreement at any time, without cause. Delivery of notice via e-mail shall be considered sufficient notice to you.   7.2 Upon termination of this Agreement you shall immediately cease using Herbal-O marks and remove Herbal-O banner(s) from your site.   7.3 Any warranties, indemnities and obligations, which by their nature are designed to survive termination, shall extend beyond the termination of this Agreement.   7.4 Upon termination of this Agreement you shall be entitled to all unpaid commissions earned prior to the date and hour of termination. However, you shall not be entitled to receive commissions for referrals delivered after the date of termination. Please note: final pay outs are made only if your account balance exceeds fifty dollars ($50.00).   7.5 Herbal-O reserves the right to terminate Herbal-O affiliate from the Program without advance notification for any reason. In such case you will be notified by e-mail immediately and paid for all sign ups accumulated up to that point in time, except in cases where it is determined you have violated this agreement in any material way. 8. Acceptance and Execution of Agreement:   8.1 By filling out and submitting the sign-up form, you are agreeing to be bound by the terms of this Agreement and Herbal-O is agreeing to become counter-party to the Agreement. The date of execution shall be the date on which the form is forwarded to Herbal-O   8.2. Accounts that are Shut Down for Spam will not be Paid. We do not allow Spam on our Network. Those Affilaites who do Spam will be Imediately Terminated and will not be Paid for any Sales Generated from Spam. 9. Accounts from the following Countries will not be Paid: BULGARIA, INDONESIA, IRAQ, IRAN, LEBANON, BELGIUM YUGOSLAVIA, SLOVENIA, RUSSIAN FEDERATION ROMANIA, JORDAN, MALAYSIA, TURKEY.
